F Gas: latest news
On 9 January 2019, Presidential Decree no. 146 of 16 November 2018 was published in the Official Journal, implementing Regulation (EU) 517/2014 on fluorinated greenhouse gases and repealing Regulation (EU) 842/2006 and the previous Presidential Decree no. 43 of 27/01/2012.
Therefore, at the end of May, no F Gas declaration will have to be submitted to Ispra.
The Decree aims to regulate the national electronic register of certified persons and companies, which ensures that all subjects have the creation and management of a database for the collection and storage of information relating to the sale of fluorinated gases and equipment containing them (pursuant to Article 6 of EU Regulation No. 517/2014), in addition to the installation, maintenance, repair and dismantling of this equipment.
Article 15 of Presidential Decree no. 146 confirms the obligation to register in the National Telematic Register of Certified Companies for companies that carry out installation, repair, maintenance and dismantling of equipment containing fluorinated gases as well as gas control and recovery.
The Register is managed by the Chambers of Commerce of the regional capitals and autonomous provinces.
Compared to what was previously foreseen, some substantial changes are introduced:
- Extension of the scope of application with reference to the equipment and activities for which registration is required
- Certificates and attestations issued pursuant to Regulation (EC) No 842/2006 remain valid in compliance with the requirements and conditions under which they were originally issued.
- All companies that, on the date of entry into force of the decree, are registered in the National Telematic Register or are new members, must obtain the relevant certificates (including training certificates) within 8 months of the entry into force of the decree, under penalty of forfeiture of the registration of the natural person and the company in the National Telematic Register.
- Paper equipment records will disappear in favor of a new online database that will be made available starting September 24, 2019
Companies that need maintenance work or other interventions on systems containing fluorinated gases that fall within the regulations are required to commission them only from companies that have the necessary qualifications, under penalty of incurring sanctions.
